Unlike clinical evaluations focused on diagnosis and treatment, court-ordered evaluations are conducted for legal purposes and are structured to meet evidentiary standards. All court-ordered evaluations at Bright Pine are private pay.

What a Court-Ordered Evaluation May Address

The scope of each evaluation is determined by the referral questions in the court order. Common areas of assessment include the following.

Competency

Assessing whether an individual has the psychological capacity to meaningfully participate in legal proceedings, understand charges, and assist in their own defense.

Criminal Responsibility

Evaluating an individual’s mental state at the time of an alleged offense to determine whether a mental health condition affected their behavior or decision-making.

Risk Assessment

Assessing risk factors related to recidivism, danger to self or others, or the likelihood of future problematic behavior relevant to sentencing or supervision.

Mental Health Status

Providing the court with a current picture of an individual’s psychological functioning, including any diagnoses, symptom severity, and treatment needs.

Sentencing and Disposition

Providing psychological information relevant to sentencing decisions, probation conditions, or diversion programs that the court may be considering.

Important: Fact Witness, Not Expert Witness

When Dr. Nuar conducts a court-ordered evaluation, she serves as a fact witness — meaning she testifies about the evaluation she performed and the findings documented in her report. Expert witness testimony, in which a psychologist offers opinions about a case they did not personally evaluate, is a separate service

Will the psychologist testify in court?

If Dr. Nuar conducted the evaluation, she can testify as a fact witness about her findings. She does not provide expert witness testimony for cases she did not personally evaluate.
